On November, 18 2005 NetJapan announced the product ShadowProtect IT Edition, and has released this product for the Japanese market. The following year, on June 30, 2006 NetJapan released ShadowProtect Server Edition and Desktop Edition. Further more, on October 2, 2006 we released a new version of ShadowProtect Server Edition 2.1 and Desktop Edition 2.1. NetJapan has consistently marketed, sold, and supported these products with the greatest effort.

Notwithstanding, a few days ago, on December 3, another company abruptly announced the release of a Japanese version of ShadowProtect Server Edition/ Desktop Edition 3.1 for the Japanese market. NetJapan was also greatly astonished by this situation. In turn, because we are receiving inquiries about the release of these same 3.x products we would like to notify you of our official point of view.

1. Concerning the release of ShadowProtect 3.1 Server Edition/Desktop
   Edition,

NetJapan would like to promptly release these products. We are presently evaluating the products, and will inform you immediately upon finishing this evaluation. However, we would like to notify you of the following serious circumstances.

2. Concerning StorageCraft Technology Corporation’s pending litigation,

In October of 2004 the company StorageCraft Technology Corporation (referred to as StorageCraft hereafter) was established in the state of Utah, U.S.A. through an investment made by NetJapan, and we have thereafter become a major stockholder. The company StorageCraft is current involved in the following 3 lawsuits.

1. In September of 2007, in the state of California, Symantec Corporation filed a lawsuit against StorageCraft relating to misappropriation of trade secrets and unfair competition. This lawsuit alleges that StorageCraft stole valuable trade secret information and materials containing sensitive and confidential personal information of employees of Symantec to develop and sale an unfair competitor product.
2. In April 2007, NetJapan, on behalf of StorageCraft, filed a lawsuit against 5 directors and officers of StorageCraft relating to breach of fiduciary duty.
3. In December of 2006, NetJapan filed a lawsuit against StorageCraft and 5 members of StorageCraft's directors and officers relating to fraud and breach of contract.
    

NetJapan while attentively watching the progress of the aforementioned litigation will hereafter carefully consider the release of Japanese ShadowProtect 3.1 Server Edition/ Desktop Edition. Note: regarding ShadowProtect 2.1 we will continue to sale and support the product as we have up to now.
